JAMES (Tuchet), LORD AUDLEY, son and heir, aged ten years in 1408. He was summoned to Parliament 26 February 1420/1 to 26 May 1455, the writs being directed Jacobo de Audley. Chief Justice of South Wales 17 November 1423,Chamberlain of South Wales 11 February 1438/9, and again 24 October 1441. He distinguished himself in the wars with France, having the chief command of some forces in 1430. On 26 October 1447, he had exemption for life, as James Tuchete, Lord of Audley, from attendance in Parliament. Having raised 10,000 men on behalf of Henry VI, he was defeated and slain by the Yorkists at the battle of Blore Heath, Salop.
He married, 1stly, Margaret, da. of William (Roos), LORD Roos, by Margaret, daughter of John (ARUNDEL), LORD ARUNDEL (Papal Dispensation.6 Kal. March 1415, to him to remain in marriage contracted but not consummated). She was living 15 Kal. September 1423. He married, 2ndly, (Papal Dispensation to remain in marriage contracted but not consummated) though related in the 3rd degree, dat. 16 Kal. March 1429/30) Eleanor, illegitimate daughter of Edmund(de Holland), 4th Earl of Kent, by Constance, widow of Thomas (le Despencer), 2nd son of 5th Lord Despencer and sometime Earl of Gloucester, daughter of Edmund (of Langley), 1st Duke of York. James Touchet, 5th Baron Audley, 2nd Baron Touchet (c. 1398 – 23 September 1459) of Heighly Castle was an English peer.
James Touchet, 5th Baron Audley, son of Elizabeth Stafford and her husband John Touchet, 4th Baron Audley, was a distinguished veteran of the Hundred Years' War. In the opening phase of the Wars of the Roses he raised troops from his estates in Cheshire, Shropshire, Staffordshire and Derbyshire and commanded the Lancastrian force that moved to block the Yorkist Earl of Salisbury's route to Ludlow where he intended linking up with the rest of the Yorkist army.
The two forces clashed in the Battle of Blore Heath on 23 September 1459 and Audley was killed by Sir Roger Kynaston of Stocks near Ellesmere (Kynaston incorporated emblems of the Audley coat-of-arms into his own). Audley's Cross still stands on the battlefield marking the spot where he died.
Audley was buried in Darley Abbey, north of Derby, about 40 miles (64 km) away from Blore Heath. Unfortunately, the Abbey no longer stands, so his final resting place is no longer marked.
Marriages and children
Audley married twice:. Firstly, having obtained a marriage licence dated 24 February 1415, to Margaret de Ros (c. 1400 - before 14 February 1430), daughter of Margaret FitzAlan (D'Arundel) and her husband William de Ros, 6th Baron de Ros. They were granted a Papal Dispensation for being related in the 3rd and 4th degrees of kindred. Together they had three children:
. John Tuchet, 6th Baron Audley (c. 1426 - 26 September 1490), son and heir.
. Elizabeth Touchet (c. 1420 - before 8 November 1464), who married Edward Brooke, 6th Baron Cobham.
. Anne Touchet (c. 1424 - 1503), who married Sir Thomas Dutton, who died at the Battle of Blore Heath (1459) along with his father-in-law.. Secondly, having obtained a marriage licence on 14 September 1430, he married Eleanor de Holland, an illegitimate daughter of Edmund Holland, 4th Earl of Kent and his mistress Constance of York, daughter of Infanta Isabella of Castile and Edmund of Langley, 1st Duke of York. They too were granted a Papal Dispensation, as they were related in the 3rd and 3rd degrees of affinity. With Eleanor de Holland he had a further seven children as follows:
. Sir Humphrey Touchet (c. 1434 - 6 May 1471), who married Elizabeth Courtenay, widow of Sir James Luttrell (1426/7-1461) of Dunster Castle in Somerset, feudal baron of Dunster, (who died fighting for the Lancastrian cause at the Battle of St Albans in 1461) and a daughter of Sir Philip Courtenay (1404–1463) of Powderham in Devon.[4] Like his father, he supported the House of Lancaster. He was taken prisoner at the battle of Tewkesbury and tried before Richard, Duke of Gloucester and the Duke of Norfolk. Executed with other Lancastrian leaders in the Market Square he was buried under the pavement in the Chapel of St Nicolas, in the Abbey Church of St Mary the Virgin.
. Thomas Touchet (c. 1440 - June 1507), who married a certain Catherine.
. Edmund Audley (c. 1443 - 23 August 1524), who served successively Bishop of Rochester, Bishop of Hereford and Bishop of Salisbury.
. Margaret Touchet (c. 1431 - before 2 February 1481), who at some time before 12 January 1459 married Richard Grey, 3rd Earl of Tankerville, son of Sir Henry Grey, 2nd Earl of Tankerville and Antigone Plantagenet.
. Constance Touchet (born c. 1432), who in 1464 married (as his second wife) Sir Robert Whitney (born 1436 - aft. 1467), an active participant in the Wars of the Roses, son of Eustace Whitney and Jennet Trussell and widower of Alice Vaughn, daughter of Thomas Vaughn.
. Eleanor Touchet (born circa 1442), who married Humphrey Grey, son of Sir Henry Grey, 2nd Earl of Tankerville and Antigone Plantagenet, in 1460.

LINCOLN. Inquisition before John Fray. Sapperton. 18 Jan. 1409.
He held the manor of Sapperton in his demesne as of fee and enfeoffed Thomas Tuchet, parson of Mackworth, and John Tuchet, clerk, with the intention that after his death they should enfeoff his heir in fee simple when he reached full age. If no heir reached full age they should enfeoff John, brother of Thomas, on condition that he took the name and arms of John Tuchet, knight. After the grant he continued to take the issues and profits to his own use. The manor is held in chief of the lady of Castle Bytham of the castle of Bytham by knight service, annual value 40s.
He died on 19 Dec. last. James his son and heir is aged 10 years and more.

He held in his demesne as of fee of the king in chief by knight service a third part of Red Castle with the lordship, annual value £22, a third part of the manor of Edgmond, annual value £21, half of the manor of Ford, annual value £19, and half the borough of Newport, annual value 9 marks.
He formerly held the manor of Leegomery and enfeoffed Thomas, parson of Mackworth in Derbyshire, and John Tuchet, clerk, to hold in safety to his use and that of his heirs, that they might after his death enfeoff his heir when he reached full age. If he failed to reach full age they should enfeoff John brother of Thomas on condition that he took the name and arms of John Tuchet, knight. Thus the manor was held to his use and he had the issues. It is held of the castle and honour of Montgomery by knight service, being in the king’s ward owing to the minority of Edmund earl of March, annual value £40.

He enfeoffed Thomas, parson of Mackworth in Derbyshire, and John Tuchet, clerk, in the two parts and reversion of the third, on the same conditions as in the last, with the addition that if John brother of Thomas died without heirs of his body they should found a hospital to pray for his soul and the souls of his ancestors and heirs. He, who held elsewhere of the king in chief, held in his demesne as of fee:
Betley, a third part of the borough. There are a third part of assize rents of 40s. payable at Lady Day and Michaelmas by equal parts, 2 watermills, annual value 26s.8d., and a third part of the toll of the borough, 2s.4d. As Lord Audley and of Heighley, by letters patent he granted an annuity of 40s. from the profits of the borough payable by the bailiffs by equal parts at Lady Day and Michaelmas to John son of James de Thikenes for life.

By letters patent he granted an annuity of 40s. from Audley, payable as above, to John Hornynglowe for life.

There are assize rents of £4 8s.10d. payable by equal parts at the Ascension and Martinmas, a third part of a third part of the enclosed pasture called Horton Lay, 13s.4d. at Midsummer and Martinmas, and a third part of a third part of 2 mills, 4s. As Lord Audley and of Heighley and Llandovery, by letters patent of 24 May 1408 he granted an annuity of 5 marks for life from these manors, payable by equal parts at Lady Day and Michaelmas to Henry Sherrard.

JAMES TUCHET SON AND HEIR OF JOHN TUCHET, KNIGHT
670 Writ for proof of age ‡ 30 March 1420. [Wymbyssh]. Teste Humphrey, duke of Gloucester.
He claims to have been born in Derby and and baptized at Mackworth in Derbyshire, and by letters patent from Henry IV [2 May 1409; CPR 1408-13, p. 76] the lands and tenements which John Tuchet, knight, held of Henry IV in chief were granted during his minority to William Roos of Helmsley, knight, whose executors should be warned. Endorsed: Simon de Leke, William Heton, and John Roos, executors of the will of William de Roos at Mackworth [sic], were warned to appear at Derby on 9 April.Derbyshire. Proof of age. Derby. 9 April. [Plumley].
Robert Irland , 60, says that James was born at Derby and baptized in the church at Mackworth on 26 Dec. 1397. He knows because he was in the church during the baptism and saw him raised from the font, and on the same day had a daughter Margaret buried at the church. John Irton , 62, was also in the church and saw James baptized. On the same day his son William was born and baptized in the church. Thomas Dodyngselles , 64, also saw James raised from the font and on the same day broke his left shin. Thomas de Bradshawe , 63 years, knows James's age from the date of his indented charter, one part of which he retains, by which he enfeoffed Thomas Tuchet, clerk , in ?1 a. arable in Mackworth on the day of James's birth and baptism. John in the Lane, 62, knows because he saw the baptism and his wife Katharine died and was buried in the churchyard on the same day. William Tuchet , 60, saw James raised from the font while he was offering mass for Katharine's soul. Robert West , 68, stood godfather to Robert son of Richard Tuchet who was baptized in the church on the same day. Richard Finche , 61, had a son Richard who took holy orders and celebrated his first mass in the church on that day. John Spencer , 66, saw James raised from the font while he was offering mass for the soul of Katharine, who was buried on the same day. Henry de Rolleston , 65, and Robert Gerard, 62, each held a large white candle during James's baptism. James and Thomas Brewode , 68, held a silver basin full of hot water in which the abbot of Darley , James's godfather, washed his hands after James's baptism.C 138/54/118 mm. 1-2

Confirmation, at his father's special request, of a charter indented (text follows), dated 13 February, 33 Henry VI, and witnessed by John Burgh, John Maynwaryng knights, John Troutbek, Roger Corbet of Morton and Thomas Charleton, whereby John Nedham and Philip More rector of Mackeworth granted a third part of the manor of Eggemondon, a moiety of the borough or town of Newporte, and all lands, rents, reversions and services in the town and fields of Little Hales co. Salop, two thirds of all the lands, rents, reversions and services in Horton Hay and a moiety of the manor of Norton upon the 'Mores' co. Stafford to the said James for life without impeachment of waste, with remainder to Thomas his son and to the heirs of his body, remainder to the right heirs of the said James, those grantors having had the premises (among other things), jointly with John Stafford archbishop of Canterbury and Ralph Eggerton esquire both now deceased, by charter of Philip Yonge and John Sherard, dated 1 December, 27 Henry VI; and confirmation with warranty of their estate therein. Stafford, a fourth part of the manor of Broghton co. Wiltesir and all their lands, rents, reversions and services in Chesturton and Broghton to the said James for life, with remainder to the said Edmund and to the heirs of his body, remainder to the right heirs of the said James, those grantors having had the premises (as in the last); and confirmation with warranty of their estate therein. Hereford, a fourth part of the manor of Beggeworth co. Gloucestre, and a moiety of the manor of Forde co. Salop to the said James and Eleanor for their lives and the life of the longest liver, with remainder to the right heirs of the said James, those grantors having had the premises (as above); and confirmation with warranty of their estate therein.
