While laws may reasonably be assumed to imply the involvement of
the police, they do not necessarily involve jail. Nor is it
necessary to ban the possession or use of smoking materials to
achieve the desired goal. It is perfectly possible to ban
PUBLIC smoking, just as many communities ban public drinking
(the definition of public may vary from place to place).
It is also possible to ban the public display of smoking
materials in places where they are available for sale. I think
if you implemented those two rules, along with further taxes
on smoking materials, you'd make life a lot more pleasant
for everybody and maybe save some lives, too.
