Know all me by th ese presents that I CATHARINE BARDEN of the County of Fayette in the State af oresaid being of sound mind and disposing memory and being mindful pf tje Cer tainty of death and the uncertainty of life do make and publish this as my la st will and testament hereby revoking all other former wills made by me. Fi rst I desire that my body be decently buried and that all my just debts and f uneral expenses be paid out of the effects of my estate as soon after my deat h as convenient. Second. I will and bequeath unto my son DAVID C. BARDIN my h ome stead tract of land Containing Two hundred acres more or less being the s ame purchased by my husband WADSIN BARDIN from one BAKER agent of Austin Coll ege also all my household and kitchen furniture that I may die seized and pos sessed of. I will and bequeath unto my son JOHN THOMAS BARDIN now a re sident of California or Oregan the unsold portion of a tract of land known as the BUTLER tract purchased by me of AUGUSTAS BUTLER on the 8th day of Januar y AD 1856 situated in Fayette County fronting on the Colorado River between m y homestead tract and a tract of 112 acres this day deeded to my Son S. D. BARDIN said unsold portion of said tract contains about one hundred and twent y acres more or less if my said Son JOHN THOMAS BARDIN should die before I do and leaving no child or children then Said tract of land to be equally enjoy ed by his Brothers or their heirs but should he die leaving lawful children o r a child then said tract of land shall decend to said child or children shar e and share alike and as I have made advancements to my other Sons GREEN S. B ARDIN, JESSE J. BARDIN and S. D. BARDIN of land and other property and have p aid debts for them so the advancements made to each of them I consider to be equal in amount to the respective property made to my said sons DAVID and JOH N THOMAS BARDIN. Fourth. If I should die Siezed and possessed of any other pr operty than the property named in this will it is my will and desire that the same shall be enjoyed equally by my sons share and share alike and it is p articularly my request in as much as I have done what I ___ to be just betwee n my said children I wish them to be satisfied with what I have done and not to have any disturbance about what little property that I have left them afte r I am dead and gone.
