Apple's known about that since at least back in July -- they announced to developers at the A2-Central Developer Conference that no one should use BASIC.SYSTEM 1.3 because it contains a bug. The same bug you found. There was an RTS instruction left out of the BASIC.SYSTEM code at the point where it was to return an error code, and instead of returning the error code, it fell through into BSAVE.
