I suspect this is due to a Modem problem.  In general, if the modem can
transmit and receive, it should have no problems at all (I am assuming a
hayes compatible modem).  Getting it to hang up is simply a matter of
sending the Characters 'ATH' which are no different from any other
characters the modem receives.  If this is not working, I'd be more likely
to suspect a relay or something of that sort.  Internal to the modem, at any
rate.  Can anyone imagine how the situation would be otherwise?
