This was mentioned at the MacHack conference.  The response was that Apple
doesn't want applications to have code that is tied to the way the current
Finder works.  Having the applications responsible for not covering up the
Finder's icons incorrectly puts the burden on the application, and
inconveniences the user if the window ends up too narrow.

The burden should be on the system to provide a way to access icons on the
desktop, and I think there are people considering this problem already.
