what?

Apple is suing because (according to apple) GEM presents the exact
look and feel of the MAC interface. Obviously if GEM were second rate,
it would present an inferior look and feel compared to the MAC. 
Consequently, Apple would have no case.

And anyway, the line of reasoning by the original poster was wierd.

Apple sues because this inferior MAC clone hurts keeps people from 
buying MACs? I'm not going to buy a Chevy because the Ford was a piece
of junk? What? It is because GEM is an excellent windowing desktop
environment, available on aggresively priced PCs such as the ST that
has scared Apple into monopolistic restraint of trade activity.
