That is, if your blood alcohol is high enough and you're stopped, you get hit with a driving while intoxicated (at least). Meanwhile, if you are stopped and your blood alcohol is just .1 below the limit, or you've been doing drugs of another sort, they can still get you for driving while impaired (DWI). BTW, I just heard an interesting story about an acquaintance who was stopped last year leaving a party with a blood alcohol level of 0.33 -- and he hadn't been drinking for a while before he left.
