The example given was a clear-cut case of murder, and would certainly result in prosecution if the officer didn't cover it up. Sure, the cop could probably get away with it pretty easily by planting a gun and claiming self-defense, but that doesn't make it legal (this all assumes that the cop would want to kill someone for almost no reason).
