Gary considered the BBS to be a store of information to be transmitted later to a third party. Gary also won- dered if there was only a difference of degree of storage and latency. Under the Model Penal Code, a conspirator is one who, with another person, agrees to engage in illegal conduct (whether it be unlawful means or an unlawful result). It would take a far stretch of the imagination to think that the phone company actually agreed to do an illegal act here.
