From page 69 of the New York driver's manual, we have:

    "If other drivers flash their lights at you when your
     lights are on low beam, this is generally an indication
     that your headlights are improperly adjusted."

And also an indication that flashing one's lights is acceptable.
Also, on page 76:

    "The law permits you to flash your headlights to warn a
     driver ahead if you can safely pass him and intend to do
     so."
