The simplistic answer is to stay that rights are "the unalienable right" of intelligent, conscious life. This is not as circular as it seems, after all if only "the right to have rights" is fundamental we have at least found one a priori thing on which to rest our other conclusions. On the other hand, i think that intelligent conscious life has rights not "a priori" but because they WANT rights and have the necessary wherewithall to protect and defend those rights which they have defined.
